Biography

Oran Doyle is Associate Professor at Trinity College Dublin, where he was Head of School from 2014 to 2018. He has held visiting positions at the Academia Sinica Taipei, Bocconi University Milan, and Keio University Tokyo.

Prof Doyle is an expert in comparative constitutional law, his recent work being published in the International Journal of Constitutional Law and Global Constitutionalism as well as a number of other journals and edited collections. He has just published 'The Irish Constitution: A Contextual Account' for Hart's Constitutional Systems of the World series. Currently supervising Robbie Noonan's work on declarations of unconstitutionality, Li-Kung Chen's work on the continuity of states, Alex Layden's work on the judicial use of foreign constitutional law, and Juan Diego Galaz's work on constitutional rights of resistance in Latin America, Prof Doyle welcomes applications for supervision from students broadly in the area of constitutional theory.

Prof Doyle is the co-chair of the British-Irish Chapter of the International Society of Public Law (ICON-S). He is also a mentor to the recently established Nigerian Chapter of ICON-S and serves on a working group that reviews applications for the establishment of new chapters. He co-convened an ICON-S symposium on constitutional silence in 2016 and the inaugural conference of the British-Irish chapter in 2017. The Chapter's next conference, organised around the theme of the UK's Departure from the European Union, will be held in Strathclyde in April 2019.

The recipient of a Provost's Teaching Award in 2008, Prof Doyle has lectured constitutional law 1 and jurisprudence to undergraduate students, and comparative constitutional law and theory to postgraduate students. He currently lectures Foundations of Law to first year undergraduate students and leads a final year research project group on democratic decay.

Prof Doyle is a regular contributor to public debates on issues of constitutional law in Ireland. He has published articles in the Irish Times on both the Children's Rights Referendum and the Marriage Equality Referendum. In 2016-17, he was a constitutional law advisor to the Citizens' Assembly considering the pro-life provision in the Irish Constitution.

Research Expertise

Description

Prof Doyle is a leading expert on comparative constitutional law and theory, with a particular focus on foundational questions of constitutionalism: how are constitutions made? How do constitutions relate to a particular people and territory, particularly in contested cases of secession and territorial conflict? How are constitutions changed? He has just published a monograph, 'The Constitution of Ireland: A Contextual Analysis' for Hart's series on Constitutional Systems of the World. This book provides the first analysis, richly informed by comparative study, of how the Irish Constitution as a whole operates in practice. The International Journal of Constitutional Law has just published an article that advances a ground-breaking theory of legal territoriality, drawing on a newly compiled dataset of how all currently in-force constitutions address territory. Prof Doyle shows how the general silence of constitutions on the scope of their national territory operates against the background of unwritten conventions that limit the geographical application of laws in a legal system. Prof Doyle's next research project will further develop this theory to provide a new toolkit for responding to secessionist claims and territorial conflict. Prof Doyle's current research explores constitution-making authority, arguing that constitutions need not be made by 'a people' but a constitution must serve the needs of those subject to it. This in turn supports his broader exploration of how constitutions relate to physical space. Prof Doyle is the co-editor of a forthcoming volume of the German Law Journal on 'Populism and Constitutionalism', for which he has written a paper that explores the links between political populism and contemporary theoretical accounts of the people's constituent power. Other recently published work explores various aspects of constitutional change, including informal change, constraints on amendment powers, interest-group politics, constitutional transitions, deliberative democracy, and typologies of constitutional change.
