Professor Aileen Kavanagh in International Journal of Constitutional Law

 

In the article, entitled 'Stopping Short of Striking Down', Professor Kavanagh examines the impact of judicial power. She suggests that the ability of judges to strike down laws is often less central to legal systems than many experts believe. By looking at how courts often find ways to resolve issues without completely cancelling legislation, her research challenges the idea that judicial review is a purely restrictive or dominant power.

Professor Kavanagh is the Chair of Constitutional Governance at the School of Law and serves as the Director of TriCON – The Trinity Centre for Constitutional Governance.
