ASSUMPTION OF RISK

- Licensee acknowledges that
the Software is intended only as a reference and training tool for medical
students and doctors preparing for postgraduate examinations.
acknowledges that, although emergency-consult ltd has made reasonable
efforts to provide good information through the software, the software
contains extensive medical information from third parties over which
emergency-consult ltd has no control. The knowledge base contained in the
software includes a significant number of common diseases as well as some
rare diseases, but should not be considered complete. The disease lists
generated by the software may not give a high ranking to, or even include,
the disease the patient actually has. This deficiency may result from one
of a number of possible causes, such as lack of complete coverage of all
possible signs and symptoms and laboratory tests and of all possible
disease entities; the inability of the software to accept the physician's
description of significant clinical findings about the patient; the
failure ofthe software to consider the underlying relations between the clinical manifestations and the
disease entities; the inadequacy of the software to cope with all of the
variations in the way that a disease can present as a result of differing
disease severity; changes in knowledge since the software was developed; or
because of user, computer or human error in designing, producing, manufacturing,
or using the software, or because of some other reasons.
- Because of these factors, it is crucial that the software be used only
as a reference tool for medical students and doctors in training,
similar to the use of a textbook or a journal article, and
that the software not be given undue weight in making diagnostic decisions. The
Software should never replace informed medical judgement and diagnosis by a
competent licensed physician. The responsibility for all decisions rests solely
with licensee. Furthermore, Ballyfoyle Ltd, trading as Emedicine.ie, has no control over the
conditions under which licensee uses the software, and Ballyfoyle Ltd, trading as Emedicine.ie,
therefore does not and cannot warrant any performance or results.
