Directive 2014/52/EU of the European Parliament and of the Council of 16 April 2014 amending Directive 2011/92/EU on the assessment of the effects of certain projects on the environment is now in force in Ireland. It has been transposed somewhat inadequately by amendments to planning legislation for projects subject to planning control. It has not been transposed for many other activities subject to EIA.

The purpose of this Course it to introduce participants to the evolving and ever changing requirements of EIA as interpreted by the EU and Irish Courts and to provide some training on complying with the procedural and higher reasoning requirements required of those preparing and assessing EIARs.

It should be of interest to lawyers, planners, engineers, construction companies, environmental professionals and anyone involved in development in Ireland.

This one-day intensive course is organised by the School of Law, Trinity College Dublin under the directorship of Professor Emerita Yvonne Scannell. This is a not-for-profit course. Proceeds from this course are used for the advancement of legal education.

Topics to be discussed include:

  • Introduction to decision-making on EIA by competent authorities.
  • When is EIA required?
  • The Environmental Impact Assessment Report.
  • Obligation on competent authorities to take other assessments into account when assessing.
  • Practical issues
  • The Assessment
  • Planning legislation and EIA
  • Consideration of a case study by participants
