About the Conference:
The decision of the Supreme Court on 21 March 2007 in Shortt v Commissioner for An Garda Sochna, Ireland and the Attorney General has significant implications for legal practitioners involved in litigation against the State, in torts litigation generally and in other areas of litigation where damages may be awarded. The judgment is the most important one on aggravated and exemplary damages in the past sixteen years. It requires close examination in order to see the new approaches it offers to a range of questions which confront practitioners involved in litigation.
The conference, organised by the Law School of Trinity College Dublin, on Wednesday, 2 May, from 6 pm to 9 pm, will provide a comprehensive analysis of the decision and clarify its implications for practice.
Among the questions it will address are the following:
What implications has the decision in Shortt for awards of aggravated or exemplary damages in negligence litigation?
Does this decision hold that the States liability in tort rests exclusively on the principle of vicarious liability?
What implications does the decision have for awards in defamation claims?
What implications has the decision in Shortt for the way in which settlement negotiations should be conducted?
How did Hardiman J regard the practice in some British cases of making an award of exemplary damages as an undifferentiated part of an award of general damages?
What are the implications of the decision for the approach taken in previous cases, such as Nolan v Murphy [2005] IESC 17, Connellan v St Josephs Kilkenny [2006] IEHC 119 (ODonovan J, 21 March 2006) and L. OK v L.H., the Minister for Education and Science, Ireland and the Attorney General [2006] IEHC 393 (de Valera J, 24 October 2006) on the question of damages for sexual abuse?
If a solicitor defending a client against a claim for a tort threatens to countersue for damages for defamation, when in fact the client is responsible, should that be the basis for an award of aggravated damages? What has Shortt to say on this question and does the judgment in Shortt have any effect on Kelly Js holding in ODonnell v ODonnell [2005] IEHC 216?
Is there any development in the Supreme Courts thinking on aggravated damages from what was said in Philp v Ryan [2004] IESC 105?
May aggravated damages be awarded against the State where its liability is exclusively vicarious in character?
If a plaintiff sues for damages for several torts (such as false imprisonment, malicious prosecution, conspiracy and negligence), should awards be made for each tort? If not, what principles should apply?
What does Murray CJ have to say on the possibility of a global award of compensatory and aggravated damages?
Does the Court establish any differences in the principles for awarding damages in tort litigation and in claims for violations of constitutional rights?
Do the limitations set out by the House of Lords in Rookes v Barnard [1964] AC 1129 apply in Ireland after the decision in Shortt?
Are punitive damages the same as exemplary damages?
Has Reddy v Bates [1984] ILRM 197 any relevance to an award of aggravated damages? Or to an award of exemplary damages?
In OBrien v Mirror Group Newspapers [2001] 1 IR 1 there was some support for using the maximum amounts that may be awarded in personal injury litigation as a guide for defamation cases. Has this approach continuing vitality after Shortt?
What has been happening recently in Britain, Canada, Australia and New Zealand in relation to awards of aggravated and exemplary damages?
Does the European Court of Human Rights decision in Tolstoy-Miloslavsky v United Kingdom (1995) 20 EHRR 442 have any implications? Has the decision in Shortt taken them into account?
Did the Court in Shortt consider it possible to include a punitive component in an award of exemplary damages against the State? If not, what are the constitutional implications?
What implications, if any, for this type of litigation follow from section 14(4) of the Civil Liability Act 1961?
Is the law as stated in Conway v Irish National Teachers Organisation [1991] IR 2 IR 305 left unchanged by the Supreme Court judgment in Shortt?

William Binchy is Regius Professor of Laws at Trinity College and is a member of the Irish Human Rights Commission. He is co-author of the Annual Review of Irish Law, a Casebook on Torts (3rd ed., 2005) and Law of Torts (3rd ed., 2000). He is co-editor of The Civil Liability and Courts Act 2004: Implications for Personal Injuries Litigation.
Dr. Neville Cox is a practising barrister and is a lecturer in Law at Trinity College Dublin. He is co-author of Sports and the Law, published in December 2004 by First Law. He lectures in, amongst other subjects, Tort Law and Defamation Law.
Dr. Ciarn Craven is a practising barrister. He lectures in Medicine and the Law on the LL.M. degree programme at Trinity College Dublin.
